General terms and conditions and reservation conditions
for accommodation contracts for the Hotel “Zur Alten Oder” Frankfurt

1. Scope

The hotel (hereinafter referred to as Hotel „Zur Alten Oder“) rents the agreed hotel room with the agreed upon to a guest (hereinafter referred to as „Guest“), guest and Hotel „Zur Alten Oder“ hereinafter referred to individually as „Party“ and collectively as „Parties“. Facilities (hereinafter referred to as “hotel room”) for the agreed period of stay (hereinafter referred to as “accommodation contract”). These General Terms and Conditions of Business and Reservation (hereinafter referred to as “GTC”) apply to accommodation contracts for the rental of hotel rooms, including all other services and deliveries provided to the guest in this context by the Hotel “Zur Alten Oder”.

2. Conclusion of contract

2.1. By reserving a hotel room, the Hotel “Zur Alten Oder” offers the guest the conclusion of an accommodation contract based on these previously made available General Terms and Conditions. If there is availability, the guest will receive a reservation confirmation from the Hotel “Zur Alten Oder” (e-mail, fax, telephone, in person), depending on the reservation variant. The accommodation contract between the Hotel „Zur Alten Oder“ and the guest is concluded when the guest receives the reservation confirmation, when the guest pays the overnight price or when the room access key is handed over to the guest – whichever occurs earlier.

2.2. Offers from the Hotel “Zur Alten Oder” to conclude an accommodation contract are subject to change and non-binding. The Hotel “Zur Alten Oder” may, at its own discretion, refuse to conclude an accommodation contract with a guest.

2.3. The guest has no right to be allocated a specific hotel room. He is only entitled to be provided with a hotel room in the room category he has booked.

3. Reservation, cancellation

3.1. The following terms „Simple Reservation“ and „Guaranteed Reservation“ differ in that with a Simple Reservation the guest only reserves a hotel room, while with a Guaranteed Reservation they also guarantee payment by providing their credit card details. The following term “cancellation” means the guest’s withdrawal from the accommodation contract.

3.2. If the guest does not show up at the Hotel „Zur Alten Oder“ by 6:00 p.m. for a simple reservation, the reservation will expire for the entire reservation period without replacement and the reserved hotel room will be available for free rental. With a guaranteed reservation, the hotel room reservation is maintained for the guest even after 6:00 p.m.

3.3. The guest can cancel simple and guaranteed reservations free of charge up to three (3) calendar days (until 2:00 p.m.) before the day of arrival, unless explicitly excluded before the reservation is completed.
Cancellations outside the free cancellation period do not automatically lead to a termination of the accommodation contract. In this case, the guest remains obliged to pay the overnight price for the reserved period of stay less fifteen percent (15%) for saved expenses.
The same applies if the guest does not show up on the day of arrival without canceling his reservation.
The guest is free to prove that the expenses saved by the Hotel “Zur Alten Oder” are higher.

3.4. In the case of early departure, in the case of simple and guaranteed reservations, paragraphs 3.3 apply. and 3.4. Sentence 1 accordingly.

3.5. The special conditions contained in section 8 apply to group trips.

3.6. If the guest decides to pay for an online reservation via a third party (e.g. Internet portals) directly using an online payment system, rebooking or canceling the reservation online is only possible according to the instructions of this third party.

3.7. Furthermore, the Hotel “Zur Alten Oder” is entitled, without prejudice to statutory withdrawal rights and after setting a deadline in advance, unless this is unnecessary due to law, to withdraw from the accommodation contract if:
• Force majeure and/or other circumstances for which the Hotel “Zur Alten Oder” is not responsible make it impossible to fulfill the accommodation contract;
• Hotel rooms or rooms are culpably booked using misleading and/or false information and/or concealment of essential facts; The identity of the guest, the ability to pay and/or the purpose of the stay may be important;
• the Hotel “Zur Alten Oder” has reasonable grounds to believe that the use of the service can endanger the smooth business operations, the security or the reputation of the Hotel “Zur Alten Oder” in public, without this jeopardizing the control or The organizational area of the hotel “Zur Alten Oder” is to be attributed;
• the purpose or reason for the stay is unlawful;
• a violation of Section 5.2. is present.

3.8. The justified withdrawal of the Hotel “Zur Alten Oder” does not give rise to a guest’s right to compensation or reimbursement of wasted expenses.

4. Arrival and departure

4.1. The Hotel „Zur Alten Oder“ will provide the guest with a hotel room in the agreed room category or furnishings on the day of arrival, subject to availability, usually from 2:00 p.m., but in no case later than 2:00 p.m., deviating from this for travel groups, but not later than 5:00 p.m., available. To access the Hotel “Zur Alten Oder” and the hotel room, the guest receives a key to a locking system when checking in at the reception.

4.2. On the day of departure, the guest must vacate his hotel room by 11:00 a.m. at the latest and hand it over undamaged. Thereafter, the Hotel „Zur Alten Oder“ can charge the guest one hundred percent (100%) of the overnight price for the guest’s use beyond the contract due to the late vacating of the hotel room. The guest is permitted to prove that the Hotel “Zur Alten Oder” suffered no damage or only significantly less damage.

5. Terms of Use

5.1. In principle, only the people named in the booking are entitled to use the hotel room. The maximum occupancy for the respective room category may not be exceeded. Babies up to the age of two (2) years will be accommodated free of charge in their hotel room when accompanied by at least one (1) full-paying adult. A baby bed can be provided upon request for an additional fee. Children up to the age of five (5) years usually stay overnight. R. free of charge in the parents‘ bed. Children who require their own bed pay the full price for an additional bed or a full hotel bed. Family rooms are mainly intended for families. The maximum occupancy of a family room consists of one (1) or two (2) adults and accordingly one (1) to three (3) children up to the age of eighteen (18), but a maximum of four (4) people.

5.2. The subletting or subletting of the hotel room provided and its use for purposes other than accommodation is generally prohibited and requires the prior consent of the Hotel „Zur Alten Oder“ in text form, whereby Section 540 Paragraph 1 Sentence 2 BGB is waived unless the guest is a consumer is.
Section 8 also applies to group trips. The assignment or sale of the claim against the Hotel “Zur Alten Oder” is also not permitted. In these cases, the Hotel „Zur Alten Oder“ is entitled to cancel the booking, especially if the guest provided untrue information to the third party about the type of booking and/or payment during the assignment/sale. Section 3.8. applies accordingly to such cancellations. Using the hotel room for any purpose other than accommodation is expressly prohibited.

5.3. During their stay at the Hotel “Zur Alten Oder”, the guest must comply with the house rules posted there.

6. Accommodation prices and other prices

6.1. The overnight price to be paid by the guest is the consideration for the hotel “Zur Alten Oder” providing the hotel room within the arrival and departure times shown in section 4. A full overnight price will be charged for each overnight stay that is reserved and not effectively canceled – regardless of the actual use or overnight stay by the guest.

6.2. The applicable prices are gross total prices excluding additional services (breakfast and/or pet fees as well as extra beds and hotel kitchen and hotel restaurant services ordered individually by the guest) and include all statutory taxes, fees and charges. In the event of changes to tax, fee and duty rates as well as the effective levying of new taxes, fees and duties previously unknown to the parties, the Hotel “Zur Alten Oder” reserves the right to adjust the prices accordingly. Local taxes that are owed by the guest according to local law, such as tourist tax or accommodation tax, are not included.

7. Payment Terms

7.1. The overnight prices and the prices for additional services are due for payment in advance at the latest when the guest arrives at the Hotel “Zur Alten Oder”, regardless of the date of invoicing. If payment is not made on time, the Hotel „Zur Alten Oder“ is entitled, if legally required, to terminate the accommodation contract with immediate effect after prior warning, whereupon the guest must vacate the hotel room immediately.

7.2. Without prejudice to Section 7.1. If the reservation lasts more than one (1) night, the Hotel “Zur Alten Oder” is entitled to require the guest to make an advance payment on the overnight stay costs up to the amount of the expected total invoice amount. Alternatively, the guest can, at his choice and with the consent of the Hotel “Zur Alten Oder”, provide appropriate security in the form of a deposit using a credit card.

7.3. The Hotel „Zur Alten Oder“ accepts cash in euros, advance payment, transfers with company costs covered, EC and Maestro cards as well as the following credit cards: Visa and Master Card. The Hotel “Zur Alten Oder” reserves the right to accept other means of payment (cash in other currencies and/or other credit and debit cards), but there is no obligation to accept them.

7.4. The guest can only assert offsetting and retention rights if the underlying counterclaims are undisputed or legally established.

8. Special conditions for group travel

Deviating from or in addition to the other provisions in these General Terms and Conditions, the following applies to a group of at least four (4) full-paying guests for whom a joint reservation exists („travel group“):

8.1. When making the reservation, a contact person („overall responsible person“) must be named for the travel group at the Hotel „Zur Alten Oder“.

8.2. Before the travel group arrives, a list of names of all participants must be presented to the Hotel “Zur Alten Oder”.

8.3. When making a reservation, the person responsible for the reservation receives a reservation confirmation from the Hotel „Zur Alten Oder“ with the essential details of the reservation made, information about check-in and, if applicable, security deposits and other payment conditions. Reservations by travel groups are always guaranteed reservations within the meaning of Section 3.1. and therefore require the provision of credit card details.

8.4. The total amount of the accommodation costs must be paid by bank transfer to the bank account of the Hotel „Zur Alten Oder“, which is stated in the reservation confirmation or which will be communicated to the person responsible by the Hotel „Zur Alten Oder“ after the reservation has been completed.

8.5. The Hotel “Zur Alten Oder” is entitled to cover the overnight costs of the travel group including the costs of additional services within the meaning of Section 6.2. at the latest twenty-eight (28) calendar days before the day of arrival, or, if the reservation is made later than twenty-eight (28) calendar days before the day of arrival, immediately with the reservation, regardless of the date of invoicing. If the travel group or the respective guest does not pay the accommodation costs when due, the Hotel „Zur Alten Oder“ reserves the right to charge the credit card provided in the amount of the overnight costs owed. If no payment has been made by the due date or if the credit card provided cannot be charged, the Hotel „Zur Alten Oder“ is entitled, taking into account the legally regulated requirements for a grace period, to withdraw from the accommodation contract and/or to terminate it extraordinarily for the travel group or the respective guest to rent reserved hotel rooms to someone else (without prior information to the guest), without the guest being able to derive any claims against the Hotel “Zur Alten Oder” from this.
Furthermore, the Hotel “Zur Alten Oder” is also entitled to request credit card details as security and to charge the corresponding amount in the event of possible damage caused by the travel group.

8.6. Upon arrival of the travel group at the Hotel „Zur Alten Oder“, the Hotel „Zur Alten Oder“ is entitled to provide a security of up to five hundred (500) euros per travel group, in particular for any additional services within the meaning of Section 7.1. as well as to claim any damage from the person responsible overall.

8.7. In deviation from Section 3.3., 3.4. the travel group can cancel or change their reservation free of charge up to twenty-eight (28) calendar days before the day of arrival. In the event of later cancellations and/or changes, the full overnight price minus fifteen percent (15%) for saved expenses must be paid. The guest/responsible person is free to prove that the expenses saved by the Hotel “Zur Alten Oder” are higher.

9. Liability of the Hotel “Zur Alten Oder”

9.1. The Hotel „Zur Alten Oder“ is fully liable for damage caused intentionally or through gross negligence as well as for damage resulting from injury to life, body or health, when guarantees are given and in the case of product liability for damage in accordance with the German Product Liability Act as well as in all other cases in which liability is necessarily unlimited under German law.

9.2. The Hotel “Zur Alten Oder” is liable for damages due to culpable violation of essential contractual obligations (cardinal obligations). Cardinal obligations are fundamental obligations that form the core of this accommodation contract, were crucial for the conclusion of the accommodation contract and on the fulfillment of which the guest trusts and may rely. Should the Hotel “Zur Alten Oder” fail to fulfill cardinal obligations due to simple negligence, the liability of the Hotel “Zur Alten Oder” will be limited to the amount that was due to the Hotel “Zur Alten Oder” at the time the service in question was provided , was foreseeable and which is typical within the framework of the accommodation contract.

9.3. Unless stated in Sections 9.1. and 9.2. Unless otherwise regulated, liability is excluded.

9.4. If disruptions or deficiencies occur in the services of the Hotel “Zur Alten Oder”, the Hotel “Zur Alten Oder” will endeavor to remedy the situation upon knowledge or immediate complaint from the guest. The guest is obliged to do what is reasonable to remedy the disruption and keep any possible damage to a minimum. Furthermore, the guest is obliged to inform the Hotel „Zur Alten Oder in good time of the possibility of exceptionally high damage occurring.

9.5. If the guest is provided with a parking space in the hotel garage or in the hotel parking lot, even for a fee, this does not constitute a storage contract. If motor vehicles parked or maneuvered on the hotel property and their contents are lost or damaged, the Hotel “Zur Alten Oder” is only liable in accordance with Section 9.1. until March 9th.

10. Theft and Damage

In the event of theft or damage to their belongings, as well as in the event of fire, water damage or other damage in the hotel room, the guest must immediately inform the hotel staff and do everything reasonable to investigate the theft or repair the damage can be helpful.

11. Pets

Bringing dogs and cats (hereinafter referred to as „pets“) requires prior notification by the guest and the consent of the Hotel „Zur Alten Oder“; For other animals, the exact species name must be requested from the Hotel “Zur Alten Oder”, whereby the Hotel “Zur Alten Oder” can refuse consent in all cases at any time and without giving reasons.
A maximum of one (1) pet can be brought per single room and two (2) pets per double room. An additional fee must be paid for each pet brought, the amount of which the Hotel “Zur Alten Oder” will inform the guest upon notification. However, exceptions are guide dogs, deaf dogs and other similar service dogs. These can be carried free of charge and at any time.

12. Food and drinks brought with you

In the public areas of the Hotel “Zur Alten Oder” it is prohibited to consume food and drinks that you have brought with you. Breakfast can only be taken in the designated rooms. It is not possible to take the offered breakfast items with you. The preparation of food is prohibited in the hotel rooms.

13. Termination of the accommodation contract

13.1. The Hotel „Zur Alten Oder“ is entitled to withdraw from the accommodation contract, taking into account the legal requirements for setting a grace period, if the guest does not make the advance payment owed by him and/or the deposit owed by him on time or in full.

13.2. The Hotel „Zur Alten Oder“ is entitled, taking into account the legal requirements regarding warning requirements, to terminate the accommodation contract with immediate effect for good cause if the guest is under the influence of illegal drugs during their stay in the hotel, the hotel room is used for the exercise of a commercial activity with customer traffic, uses the hotel room for prostitution, repeatedly insults or physically attacks hotel staff or other hotel guests despite warnings. Furthermore, in such a case, the guest can be expelled from the house.

14. Final provisions

14.1. Should individual provisions of these General Terms and Conditions be or become ineffective or void, this will not affect the effectiveness of the remaining provisions.

14.2. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict of laws.

14.3. The place of fulfillment and payment as well as the exclusive place of jurisdiction – also for check and bill of exchange disputes – in commercial transactions is the ordinary court with local jurisdiction for the Hotel „Zur Alten Oder“. This jurisdiction regulation also applies if the guest does not have a general place of jurisdiction in Germany. However, the Hotel “Zur Alten Oder” is entitled to bring lawsuits and other legal proceedings at the guest’s general place of jurisdiction.
